2 of the more moderate conservative justices joined with the 3 liberal justices to make a majority. I have the SLIGHT feeling that Roberts specifically is worried about public perception of the court dropping even lower, so he’s trying not to send them off the deep end.
if that’s the reason, i’ll take it. lately it feels like the conservative side stacks its own deck, completely at its own discretion and without recourse, so if this helps to even the playing field, then so be it.
Latest 538 podcast goes into this. They feel it’s probably a mix of public perception and preference toward incremental change from Roberts and Kavanaugh to a lesser extent. So the issue may return later.
